Terms of Use

Safety first: Sleepy plays sound. It is not a baby monitor, not a medical device, and no substitute for supervision. Keep the phone out of the crib, and keep the volume low and well away from your baby's ears.

These terms are an agreement between you and Tidybit, an independent app developer ("we", "us"), covering your use of the Sleepy iPhone app. By downloading or using the app you accept them. If you do not accept them, please delete the app.

1. Safety and intended use

Sleepy is a comfort and relaxation tool for parents and caregivers. It plays looping sounds and fades them out. Please read this section carefully:

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Sleepy on Apple devices you own or control, as permitted by the App Store terms. The app, its sounds, artwork and code remain our property. You may not copy, resell, reverse-engineer, or extract the audio content for redistribution.

Your use is also subject to Apple's Licensed Application End User Licence Agreement. Where these terms and Apple's standard EULA conflict, these terms govern to the extent permitted, except that Apple's terms always govern your relationship with Apple.

3. Free features

Eight sounds are free to use, with no time limit, no account, and no advertising. We intend to keep them free permanently, and we will not move them behind the paywall.

4. Purchases and subscriptions

Premium unlocks the full sound library and the extended timer options. It is sold in three forms:

Prices are shown in your local currency in the app, and may differ from the figures above because of Apple's regional pricing and local taxes. The price displayed at the moment of purchase is the one that applies.

Payment is charged to your Apple Account on confirmation. Subscriptions renew automatically at the same price unless cancelled at least 24 hours before the end of the current period. Manage or cancel a subscription in Settings on your iPhone, under your name, then Subscriptions. Deleting the app does not cancel a subscription.

If a free trial applies, any unused portion is forfeited when you buy a subscription. Apple will charge for the first paid period at the end of the trial unless you cancel at least 24 hours before it ends.

If we change the price of an existing subscription, Apple will ask for your consent before charging you the new price, and you may cancel instead.

5. Refunds

App Store purchases are sold by Apple, and refunds are granted by Apple under its policies. We cannot issue them ourselves. Request a refund at reportaproblem.apple.com. If you are stuck, write to us and we will help where we can.

6. Privacy

Sleepy has no accounts, no analytics and no tracking. What it stores, and the one purchase-related exception, are described in the privacy policy, which forms part of these terms.

7. Availability and changes

We may update, change, or discontinue the app or any feature, and we may revise these terms. If a revision materially affects your rights, we will update the date at the top of this page. Continuing to use the app after a change means you accept it. If you hold a lifetime purchase and we discontinue the app entirely, that purchase is not refundable by us, though you may still request a refund from Apple.

8. No warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that playback will be uninterrupted or error-free: the operating system, other apps, a phone call, or a low battery can all stop audio, and you should not rely on the app for anything critical.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the claim arose.

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of the two sections above may not apply to you. If you are a consumer, you keep all mandatory rights granted to you by the law of your country of residence, and nothing here overrides them.

10. Apple

Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
